Terms of service

This General Terms and Conditions (hereinafter: GTC) contain the rights and obligations of Topcycler Ltd. (hereinafter: Service Provider) and the Customer (hereinafter referred to as Customer) using the electronic commercial services provided by Service Provider through the website www.medencedesign.com (Service Provider and Customer together: Parties). The GTC covers all legal transactions conducted on the website, www.medencebag.com.

Agreeing to the GTC is necessary for using the services provided through the website, i.e., for placing orders and shopping. When beginning to use the service, the buyer expresses their agreement to abide by the GTC and the service provider's Data Protection and Privacy Policy (hereinafter: "Policy"). The policy is an integral part of the GTC, and it should be interpreted in light of its provisions.

Customer

The customer is a user who uses the service through the website, places an order, and makes a purchase.

Scope and amendment of the GTC

The Service Provider has the right to modify parts of, or the entire GTC. The Service Provider posts a short announcement on its website to inform website visitors and users of the newest amendment of the GTC. The GTC and all its amendments come into effect at the time of their publication and following the publication. When starting to use the Service, the Website Visitor and User agrees to and consents to being bound by the amended, valid GTC.

Geographical scope of the Service

The Service Provider’s Website can be accessed domestically and from abroad as well. However, the Service Provider can provide its services only in specific countries in Europe. In the unspecified countries Service Provider can provide services only under specific conditions agreed in a preliminary e-mail correspondence (shop@medencedebag.com) but even then, it cannot guarantee Service provision in these countries.

Concluding an agreement between Service Provider and Customer

The precondition of using the Service is agreement to this GTC and the related GDPR provisions. By using the Service, placing an order and agreeing to the GTC and, at the same time, the Policy, the User concludes a contract with the Service Provider. The subject of the contract implies the purchase of products ordered through the Website and their home delivery in the framework of retail trade. The Service Provider registers the contract and stores it in a database. The Service Provider is not liable for any breach of contract or a lack of conformity with the contract in case of vis maior.

Goods and services available for purchase

The Webshop sells unique, artisan design products, made – in the spirit of sustainability – mostly of recycled materials. The ordered products can be obtained only through home delivery. The images shown in the webshop are illustrations, they may differ from the real products. The prices shown are gross amounts but they do not include the price of home delivery.

Information on ordering

The showcased products can be ordered online, through the Webshop only, with home delivery carried out by a courier service.

The prices indicated next to the products include the statutory 27% VAT but exclude the price of home delivery. In case the Service Provider indicates an incorrect price next to the product, despite having acted with due diligence, and the product’s price differs from the generally accepted price, then the Service Provider is not bound by the faulty price but is obliged to offer, when sending a confirmation about the order, the opportunity to purchase the service at the real price. If the Customer does not wish to use this opportunity, then he/she has the right to unilaterally withdraw from the contract.

Customers may browse among the products by category. In addition to the product listing, short product descriptions are provided with the price and a non-exhaustive list of additional features of the product. Should you wish to receive more information about the product, then click on its picture or its name. Then you will be directed to the product’s page, where you can find more detailed information about it. In case you need even more details, then please contact the Provider on the phone number listed among the Provider data or through the e-mail address shop@medencedebag.com.


Course of order

  1. Click on the button “Basket” to place the product into the Basket.
  2. You can check and modify the content of the basket by clicking on “Basket” in the menu. Here you can check, modify, or even cancel the items placed in the basket. If you find everything correct and you have decided to order the selected products, then click “Pay” to finalise your order.
  3. Once you have finalised your order, we will send you an automatic confirmation with the details of your order to the e-mail address that you provided. If you do not receive such a message, then the system did not accept your order. In this case please contact us through the above-mentioned contact details listed under the Provider data. The delivery can take place only after this. The order is completed if the Provider confirms it in an email and the payment is done.
  4. It can happen that one of the items you choose does not appear in the automatic confirmation, and the amount to pay is lower than it was in the basket.

It is important to notice that we are selling unique design products. Our products can be chosen in the webshop until someone buys them. Another customer can buy the product while it is in your basket and not paid yet.

Processing orders

After placing your order, we will send you the details of your order via email. Orders are processed on working days between 12-18h. You may place your orders at other times as well, in which case your order will be processed on the first working day after making the order. The delivery of the accepted order must take place within 5 working days after the confirmation.

The service provider bears no liability for any delays, problems, or mistakes with respect to home delivery caused by wrong and/or inaccurate data provided in the course of the order.

Payment of the price of the ordered product and home delivery

Payment of the purchased products

Through the Stripe online payment system, debit cards are required to pay for orders and home deliveries. The following cards are accepted: Mastercards, Maestro, Visa, Electron, and Amex.

Before payment, please make sure that you have used Stripe’s server to provide the card details and the password. Stripe has a PCI DSS certificate, which is mandatory for credit card companies, thus, it is authorised to process data related to bank cards. The security system of SimplePay servers was designed in line with the prescriptions of the National Bank of Hungary. By consenting to this GTC, you consent to the GTC of Stripe as well.

The shipping fee is calculated together with the order, depending on the shipping address provided by the user. The service provider sends a confirmation email, including the original invoice or receipt of the service, with data provided at the time of making the purchase.

The amount to be paid is based on the order details and the confirmation email, and it includes all the fees. The invoice will be included in the package. Please check the package at the time of delivery, in front of the courier, and if you note any damage or defect, then request that a report be recorded and do not take over the package. We cannot accept any post hoc complaint in the absence of a report.

Delivery Terms for Hungarian addresses by GLS

Flexible delivery: GLS informs recipients early about the delivery of parcels and offers a variety of delivery options to choose from.

As soon as the ordered goods are ready to be shipped, recipients receive an e-mail or a text message containing information about the upcoming delivery of GLS parcels. The message includes all important parcel data, the number of the customer service representative, and a direct link to the GLS Delivery Manager. The online tool allows recipients to choose from a variety of delivery options. For example, they can select a new date for delivery, enter a different address, or redirect the parcel to a GLS ParcelShop.

In the morning of the delivery day, GLS sends a second e-mail or text message to the recipient containing a three-hour delivery time frame. The message also includes the number of the delivery driver and the customer service number. At this time, the GLS Delivery Manager cannot be used anymore.

If the first delivery attempt is not successful, GLS automatically sends a third e-mail or text message to the recipient. It is now possible to choose from the delivery options for the second delivery attempt via the GLS Delivery Manager.

Usually, GLS attempts to deliver a parcel twice. But if the sender has booked the FlexDeliveryService, GLS will deliver a third time if necessary. In this case, GLS will once again inform the recipient via e-mail or text message about the upcoming delivery.

Receiving parcels becomes flexible, making the shipment of goods to private households less complicated. The number of inquiries and complaints to the sender decreases, while customer satisfaction, on the other hand, increases.

Delivery Terms for foreign addresses by Packeta

As soon as the webshop (service provider) hands over the product to the supplier, csomagkuldo.hu will immediately send an email to the customer with a tracking ID.

In cases of unsuccessful delivery and returned packages, the costs of re-delivery and return will be charged to the customer; the package will be dispatched again only if the price of the package has been paid in advance.

Right to cancel

Pursuant to Government Decree No. 151/2003. (IX. 22) on compulsory guarantees for certain consumer durables, this point is applicable only to customers qualifying as consumers. Consumers may withdraw from the contract without any justification within 14 days after delivery. They can return the package if it has been unopened and is intact. If the consumer exercises his/her right to cancel, then he/she is obliged to submit a clear, written statement to the operator (by registered post with a form for acknowledgement of receipt or in an email). The operator is obliged to send a confirmation of it to the consumer without delay, after receiving the statement. In the event that the consumer cancels the order, then he/she is required to return the product to the operator within 14 days after submitting the statement. The consumer is responsible for covering the costs of returning.

In case the user exercises his/her right to cancel, then the service provider is obliged to refund the payment, including the delivery fee, within 14 days after receiving the customer's statement to this effect. The exception is if the customer opts for a shipping method that implies extra costs and which differs from the usual shipping method. The service provider is not obliged to fulfil its repayment obligation as long as the product has not been returned or until the consumer provides credible evidence about the returning of the product. In case the two dates differ, the operator shall consider the earlier time.  

The operator is entitled to demand compensation for any material damage caused by unintended use of the product. Therefore please make sure to use the product appropriately, as the Consumer is liable for the material damage due to unintended use.


Guarantee

Pursuant to Government Decree No. 151/2003. (IX. 22) on compulsory guarantee for certain consumer durables and for the products sold by the Service Provider, the consumer is entitled to a one year warranty of the product from the day the product was received. The Service Provider sells unique, artisan design products, made – in the spirit of sustainability – mostly of recycled, and factory leftover materials (such as advertising mesh/banners, truck tarpaulins, sunroof textile, cabrio-roof textile). These raw materials are used for a purpose that is different from their original function, therefore we cannot guarantee the quality of the materials, nor the printing on them, the guarantee does not cover this aspect. They can become frayed. In order to ensure the quality of our products, we draw on our experience of the past 14 years in trying to eliminate raw materials that may be easily frayed due to the cold or mechanical stress. In case a guarantee is enforced, the Consumer is entitled to having the product repaired or replaced for free of charge. The repair work under the guarantee covers defects due to manufacturing defect. We warrant the quality of the accessories used: zips, yarn, plastic buckles, production and sewing. Getting the product to the warranty service point is the responsibility of the customer.


Other provisions

In matters not regulated by these General Terms and Conditions, Act V of 2013 on the Civil Code, and with regard to consumer contracts, the government decree 45/2014 shall be referred to.


Legal dispute

The Service Provider makes every effort to settle out of court any kind of disagreement or dispute under the contract between the Provider and the registered Service User. In case the potential legal dispute cannot be settled through negotiation, the only authorized courts are the one competent in the geographical area of the Service Provider’s registered address, or the court competent to act according to the product’s value.

In matters not regulated by this GTC, the measures stipulated in the Civic Code, as well as the legislation and regulatory provisions in force are also relevant without any further clause with respect to the Service Provider’s business activities, qualified as the Service.
